Il permet d&rsquo;acheter une maison, au fil du temps, en l&rsquo;occupant temporairement comme un locataire.<\/p>\n\n\n\n<p>Avec le d\u00e9cret l\u00e9gislatif \u00ab ouvrir l&rsquo;Italie \u00bb (d\u00e9cret 133\/2014, art.23), le gouvernement a r\u00e9cemment r\u00e9glement\u00e9 le recours \u00e0 ce type de contrat.<\/p>\n\n\n\n<p>Regardons de plus pr\u00e8s ce qu&rsquo;il en est :<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">1. Qu&rsquo;est-ce qu&rsquo;un contrat de \u00ab location-vente \u00bb ?<\/h2>\n\n\n\n<p>C&rsquo;est un nouveau type de contrat qui regroupe \u00e0 la fois le bail et la vente de la propri\u00e9t\u00e9. Ce qui signifie que :<\/p>\n\n\n\n<p>\u2022 Le propri\u00e9taire, au d\u00e9part, transf\u00e8re la propri\u00e9t\u00e9 au <a title=\"immobilier en Italie\" href=\"https:\/\/fr.gate-away.com\/\" target=\"_blank\" rel=\"noopener\">futur acheteur<\/a>, qui en retour fait des r\u00e8glements p\u00e9riodiques \/ mensuels<\/p>\n\n\n\n<p>\u2022 Le futur acheteur, d\u00e8s le d\u00e9part, profite de l&rsquo;usage de la propri\u00e9t\u00e9, assume les risques que cela implique et r\u00e8gle tous les co\u00fbts y compris les charges de copropri\u00e9t\u00e9 et toutes les d\u00e9penses li\u00e9es \u00e0 l&rsquo;entretien de la propri\u00e9t\u00e9, si pr\u00e9vu dans le contrat.<\/p>\n\n\n\n<p>\u2022 Le futur acheteur peut, apr\u00e8s une certaine p\u00e9riode, d\u00e9cider d&rsquo;acheter l&rsquo;actif, en d\u00e9duisant une part des loyers pay\u00e9s et l&rsquo;acompte (environ 6 % du prix d&rsquo;achat). Mais il n&rsquo;est pas oblig\u00e9 de l&rsquo;acheter, dans ce cas, le bail n&rsquo;est plus consid\u00e9r\u00e9 comme une location-vente.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">2. Quel est le d\u00e9lai pour consentir \u00e0 acheter la propri\u00e9t\u00e9 ?<\/h2>\n\n\n\n<p>Les deux parties d\u00e9terminent la p\u00e9riode pendant laquelle le futur acheteur peut d\u00e9cider d&rsquo;acheter la maison. <strong>Le d\u00e9lai maximum est de 10 ans<\/strong>. A l&rsquo;origine, la p\u00e9riode maximale \u00e9tait de 3 ans.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">3. Quelles sont les autres nouveaut\u00e9s ?<\/h2>\n\n\n\n<p>\u2022 L&rsquo;<strong>enregistrement<\/strong> du contrat aupr\u00e8s du Bureau du cadastre.<\/p>\n\n\n\n<p>\u2022 Le futur acheteur est <strong>prot\u00e9g\u00e9 de toutes les \u00ab\u00a0circonstances impr\u00e9vues\u00a0\u00bb<\/strong> qui peuvent concerner le futur vendeur avant le transfert de propri\u00e9t\u00e9.<\/p>\n\n\n\n<p>Par exemple, si le vendeur vend la propri\u00e9t\u00e9 \u00e0 un tiers, apr\u00e8s l&rsquo;enregistrement de la propri\u00e9t\u00e9, les droits du locataire\/futur acheteur de la propri\u00e9t\u00e9 sont maintenus, m\u00eame si l&rsquo;accord d&rsquo;achat vient ensuite.<\/p>\n\n\n\n<p>\u2022 Dans le cas de versements impay\u00e9s de la part du futur acheteur, le contrat prend fin et le propri\u00e9taire a le droit d&rsquo;expulser le locataire\/futur acheteur. Ceci s&rsquo;applique m\u00eame si les paiements non honor\u00e9s ne sont pas s\u00e9quentiels. Les montants des impay\u00e9s qui entra\u00eenent l&rsquo;expulsion, et qui ne peuvent \u00eatre inf\u00e9rieurs \u00e0 1\/20e du montant total, sont d\u00e9termin\u00e9s par les deux parties.<\/p>\n\n\n\n<p>En cas de non-ex\u00e9cution de la part du vendeur, ce dernier doit rembourser les versements avec les int\u00e9r\u00eats l\u00e9gaux. Les parties sont oblig\u00e9es de d\u00e9finir la proportion des versements que le vendeur doit rembourser \u00e0 l&rsquo;acheteur en cas d&rsquo;\u00e9chec de ce dernier \u00e0 faire valoir son droit d&rsquo;acheter la propri\u00e9t\u00e9, dans les m\u00eames limites de temps.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">4. Quels types de propri\u00e9t\u00e9s peuvent \u00eatre mis en location-vente ? Est-ce que cela inclut les propri\u00e9t\u00e9s en construction&nbsp;?<\/h2>\n\n\n\n<p>La \u00ab location-vente \u00bb concerne tout type de <a title=\"Gate-Away.com\" href=\"https:\/\/fr.gate-away.com\/\" target=\"_blank\" rel=\"noopener\">propri\u00e9t\u00e9<\/a> : maisons individuelles, appartements, garages, espaces de stockage souterrains, boutiques, bureaux, entrep\u00f4ts et magasins. M\u00eame des terrains.<\/p>\n\n\n\n<p>Cela concerne aussi les biens en construction. Si le constructeur\/propri\u00e9taire se d\u00e9clarait en faillite, le locataire\/futur acheteur ne perdrait pas d&rsquo;argent et le contrat perdurerait en cas d&rsquo;\u00e9chec du vendeur.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">5. Quelles sont les taxes \u00e0 payer ?<\/h2>\n\n\n\n<p>Un plan fiscal sp\u00e9cifique pour ce type de contrat vient d&rsquo;\u00eatre annonc\u00e9.<\/p>\n\n\n\n<p>Comme dit pr\u00e9c\u00e9demment, le paiement mensuel inclut 2 versements diff\u00e9rents qui sont sujets \u00e0 2 taxations diff\u00e9rentes.<\/p>\n\n\n\n<p>\u2022&nbsp;Le loyer que vous payez mensuellement pour vivre dans la propri\u00e9t\u00e9 est assujetti \u00e0 la r\u00e8glementation sur les baux et vous ne paierez pas de TVA, sauf si le vendeur est le constructeur.<\/p>\n\n\n\n<p>\u2022&nbsp;A l&rsquo;inverse, la part que vous payez chaque mois, qui est d\u00e9ductible \u00e0 la fin du prix total, est assujettie \u00e0 la r\u00e8glementation concernant les acomptes.<\/p>\n\n\n\n<p>Il est toujours recommand\u00e9 de demander l&rsquo;aide d&rsquo;un professionnel, g\u00e9n\u00e9ralement un notaire (\u00e9galement n\u00e9cessaire pour l&rsquo;enregistrement du contrat) qui pourra \u00e9valuer la transaction dans sa globalit\u00e9.
